Gormley was sentenced to only five years probation for his second rape by Green County Circuit Court Judge
Calvin R. Holden, according to KY 3, after being persuaded by his probation officer and sex abuse program counselor that he was “making progress in his counseling.”
Judge Holden sentenced Gormley to probation because he seemed to be getting better in counseling,
Even though the prosecution had asked for the maximum punishment of seven years in prison. But after
Gormley finished a similar program designed to rehabilitate the sex offender, Holden chose to ignore the fact that Gormley had raped his second victim.
Elizabeth Fax, the prosecutor, expressed dissatisfaction of Judge Holden’s decision, pointing out that Gormley committed his second violation while on probation.
