Justices warned that allowing the removals to continue risked “irreparable harm” and could place individuals beyond the court’s reach — permanently.

Justice Brett Kavanaugh issued a concurring opinion urging expedited final resolution:

“The circumstances call for a prompt and final resolution, which likely can be provided only by this Court.”

Justices Clarence Thomas and Samuel Alito dissented, arguing the court should have allowed the appeals process to play out in the lower courts.
