According to an inquest, an 11-year-old girl’s half-brother will not face charges despite the fact that he “punched in the heat of the moment” just before the child collapsed and died in the family home’s bathroom.

More than three weeks after her body was discovered on the floor of the bathtub at her family home on February 20, 2022, Falaq Babar passed away in the hospital.

Suhail Mohammed, her adult half-brother, acknowledged to sending the punch in a text message to his girlfriend; the inquest heard how the police decided they had enough evidence to prosecute him with manslaughter.

Although the inquest has not yet considered the “complex medical evidence” about the possibility of a “underlying” medical problem in Falaq, the Crown Prosecution Service chose not to go further with the case.

According to the inquiry, Falaq’s parents also refused to let the police question her younger brothers, who were in the toilet with her at the time of the event and were five and seven years old, respectively.

Mr. Mohammed said that he overheard Falaq “screaming her head off” while in the restroom and proceeded to shoulder-charge the blocked door.
