Though Dickerson finally rejected a settlement that would have awarded her only $3 million (£2.27 million) of the prize,
a frequent couple at the Waffle House testified that she had informed them about the arrangement. She then left the court without saying anything.
After that, the waitress filed an appeal with the Alabama Supreme Court, which overturned the Circuit Court’s decision on February 18, 2000,
holding that because the arrangement “was founded on gambling consideration,” which is unlawful in Alabama, it could not be unenforceable under state law.
