The Biden administration’s emergency request to implement a component of a new regulation that incorporates
Title IX safeguards against discrimination against transgender students was denied by the Supreme Court on Friday, 5–4.
In ten places where state and municipal laws prohibit it, the proposal would have allowed biological guys in women’s restrooms, locker rooms, and dormitories.
The comprehensive regulation, which was released in April, made it clear that discrimination on the basis of gender identity,
sexual orientation, and “pregnancy or related conditions” is prohibited under Title IX, which prohibits “sex” discrimination in schools.
