A Manhattan jury finds Daniel Penny not guilty, breaking the news.

 

Yoran told jurors that Penny had “laudable” intentions, but she said he held Neely for too long. The defense’s claim that Neely posed a danger to passengers for many minutes.

After the conflict began was likewise refuted by the prosecution. Yoran informed the court that “everyone the defendant wanted to protect had already left the train.”

Aoard both days, Penny’s defense attorney, Steven Raiser, asked the jury to imagine themselves aboard the train at the time of the occurrence.

Neely “scared the living daylights out of everybody,” according to passengers in police bodycam footage he played on Monday, along with sound effects.

On Tuesday, Raiser gave the jurors another presentation of the scenario. According to the New York Post, he questioned, “Who do you want on that train ride with you?”

According to ABC News, a defense attorney said Monday that a “violent and desperate” Neely entered the train in 2023 “filled with rage and not afraid of any consequences.”
