NEW YORK: In the death of Jordan Neely, a homeless man whom former Marine Daniel Penny choked.
On a subway vehicle in New York City last year, a jury on Monday found Penny not guilty of criminally negligent murder.
The jury informed the court at 11:30 a.m. Monday that they had unanimously decided on the case’s second count.
Due to the jury’s inability to reach a judgment, the more severe allegation of second-degree manslaughter was dropped Friday.
Video of the chokehold went viral after Neely’s death, which a New York City medical examiner said was due to “compression of the neck.”
This pushed the case into the national limelight. Neely had schizophrenia, was high on synthetic marijuana, and was screaming.
