Disney has denied a man the right to file a lawsuit for his wife’s death on the grounds that he maintained a Disney+ account.

 

The cause of her death was determined to be a severe allergic reaction (anaphylaxis), and it was classified as accidental.

Piccolo filed a lawsuit against the Walt Disney Company and the restaurant, asserting that his wife’s death was “completely preventable” and could have been prevented if “proper protocols” had been adhered to.

The claim alleges that Disney failed to “educate, train, and/or instruct its employees to ensure that food that was indicated as allergen-free or requested to be made allergen-free was in fact free of allergens.”

However, Disney is attempting to dismiss the wrongful death litigation and refer it to arbitration as a result of the terms that Piccolo consented to when he signed up for a Disney+ account in 2019.

The BBC reported that he also allegedly consented to the same terms and conditions when he purchased tickets to the Disney theme park in 2023.
