Disney has denied a man the right to file a lawsuit for his wife’s death on the grounds that he maintained a Disney+ account.

 

Disney claims that Piccolo consented to the terms of their “Subscriber Agreement” as outlined in section seven when he registered for a one-month trial of the streaming service.

It stipulates that disputes must be resolved through arbitration rather than litigation. This implies that disputes must

be resolved through a neutral third party, as opposed to a formal judicial procedure in which a judge or jury determines the case.

Disney’s motion explained that “The first page of the Subscriber Agreement states, in all capital letters, that

‘any dispute between You and Us, Except for Small Claims, is subject to a class action waiver and must be resolved by individual binding arbitration’.”
