At which a kid may be left alone, Mario Massillamany, an attorney not engaged with the case, thinks the state has a good case against Gardner. Massillamany told Fox 59,

“The law doesn’t specify a specific age because the law doesn’t want to specify an age.” In this case, you have two and three-year-olds. They are obviously unable to be alone.

“You don’t have to show she intentionally tried to harm them when it comes to neglecting a dependent,” Massillamany said. She just placed them in a life-threatening circumstance.
